    Hi Folks,
    Great forum... just want to say, I (US citiizen) applied for my wife via I-485 and went through the interview and got approved. She just recieved her Green card in the mail a week ago, so we are very happy. The lawyer we got to help out was good, but he mentioned that we need to close out her case or else she will not be able to travel and re-entry, because in the computer, there's still a removal order for her. He said we are 90% there, and we just need to close out the case. Here's my questions because even though I appreciate the lawyer was able to get this all set, he pretty much charging me 1000 everytime I pick up the phone w/ him.

    1) How hard is it to close a open case when the person already got the green card

    2) What application(s) or cost is associated with closing the case.

    3) how long this process takes

    4) Even though she got green card, what precaution do we need to take

    At this point, we really just want to get this behind us and move on with our lives.. we want to go to Europe for our Honeymoon

    Just want to say Thanks in Advance for any help on this.

    What the hell is he on about closing a case? What case? What removal order are you talking about. Did you AOS from a K1 or 130 Once your wife has GC she is free to do what she wants. She is now a legal permanent resident. Is it a conditional GC (2years) or a 10 year GC? You do not need to close anything off OMG!!!! I just got my GC approved from K1 and I will get a 2 yr card and I have to remove conditions within 90 days of our 2 year anniversary but thats it. There is no closing of anything. He is full of it if he thinks that unless you have another case not mentined here. You can go on your honeymoon as she has GC now and its in her married name yes? so you are sweet. he is wanting more money sounds like it.

      Hi Barbarajlw,
      My wife went to court 5-6 years ago to get asylum here, she was deny by court and was ordered to return to her country. We got married last year, and we apply the i-130 & i-485. During the Immigration interview, the officer told us that in the computer there's an order for her removal.. in this circumstance, my wife would've been detained at the spot... but the lawyer had reopened her case prior to us going into the interview for our protection.. the reason he did that is to make sure she don't get detain during the interview.. because any case that is pending/re-opened will help 'protect' my wife from being detained on the spot.
      After the interview, the officer approved that our marriage is legit and thus her green card arrived. Now as for the re-opened case.. we need to close it to this whole process will be complete. Let me know what you think.

        forgot to add.. its a 2yr conditional GC.. and we would need to get the removal later on

          Well from what I have learned USCIS are well aware of the removal order and they would not have granted her the GC if it was an issue. It will always be on her records but I have not heard of such a thing as closing it. It just stays there on her record and that's it.
          She went back to her country and you married and now she is married to USC so there should be no problem. You did the right thing an applied for 130-485 and did it all legal. If you needed to close anything USCIS would have mentioned it. As I said it just stays on her file and USCIS would have made notes. Yes within 90 days before your 2 years is up you apply for removal of conditions. I-751 Don't go paying anymore to this lawyer if you need to know anything call USCIS

            Ineligibility/ denied application for asylum/ order of deportation

            Hello Motapsycho7,
            I think that you should pay the lawyer and let him handle whatever it is that needs to be done, becuase your wife was statutory ineligible to be awarded a LPR, being that she refused to obey a standing immigration court order that ordered her to leave the country, she was a fugitive as at the time she was awarded her GC. SHE OUGHT TO HAVE BEEN DETAINED at the interview, thank God that President Bush is not in power, when ICE officers were acting like Roman Generals and or Lord Protector of USA( she would have been sweeped into detention and deported pronto). She has some how escaped grounds of ineligibility, no amount of money is too much let that lawyer finish his good work lest you be penny wise and pound foolish.

              Removal Order

              Yes, your lawyer is correct. Your wife's GC can be revoked anytime. Only the judge who ordered the removal proceeding can pardon her.
              FatPhysco, don't look at the money at this stage, look at the piece of mind. We are no experts here and you may end up getting ammature advice from this forum and may regret later.

                Thank you for the advice, yes the lawyer was able to protect her during the interview..because he had mentioned that if he didnt' apply for hardship and reopened the case, Immigration would've halled her away at that moment. I have already told the Lawyer to do what he needs to do to close out this case.
                I was glad that the Immigration officer that interview us was a very nice lady and that we joked around during the process.
                The lawyer said that it'll take month or 2 month to get this done. So we are waiting as of now. I figure I wanted to do some homework on this process to see what we can DO on our end to speed this up. I'll leave it to the lawyer and see what happens.
