  • Abandonment of application?

    Hi

we went for our marriage based interview today. My American husband applied for AOS for me (the wife) and my son in October 2010. We have been married for 4 years, my son was 15 when we got married and we all live together..
The interviewer did not ask one question from me or my husband. She told me in the first 5 minutes that I am approved. However, she said my son,who traveled to Canada for 2 days in November 2010, a month after we filed for AOS, is denied the green card, because he abandoned his application by leaving the US. No one ever told us we cant travel while waiting for interview. The son is in college and he went to Canada with his study group for 2 days, he has a valid passport, visa and I-20.
What are we supposed to do now and why is it not allowed to travel, and how would I have known that? Please advise

While you are waiting for Green card to be approved you would have had to applied for Advance parole travel document re entry permit. No one can leave the US while GC is pending without the AP. He was lucky he got back in. I am sure someone else can help you here but I presume you can appeal it. To be honest if you had read thoroughly the information about Gc you would have known about the leaving.
