    Hello everyone! I’m happy to find a website and forum like this. I’m sure it helped and gave a lot of good information to a lot of people, including me.

    I need advice, comments and or suggestions about me and my husband’s situation…

    This is going to be long but I hope you guys will have the time to read it. Thanks in advance!

    This is the situation…
    My husband came here to the U.S. as an immigrant (CR-2) on June 1998, he was petitioned by his Stepfather and got a green card (2 year conditional), he got a SSN and got a job. But when it was time to take off the conditional, unfortunately, his mom and step dad got divorced and the step dad didn’t continue the petition to take off the conditional until his GC expired in 2000. Then, they asked for 1 year extension of the GC. My husband’s sister who’s a USC filed a petition for him instead, but it didn’t worked out because we all know that it takes years and years to petition a sibling, until his 1 year extension also expired which was on June 2001. He never left the U.S. and overstayed, he’s been out of status since then but still working up to now using his SSN. I am a USC and we got married last year (Nov. 2010), we have a common kid (he was born a year before we got married). We’re working on getting all the forms and documents together right now (so he can file for AOS).

    Is it going to be a problem once we file all the paperwork and he’s still working? Or does he need to quit from his job before filing? Because he will also need to file I-765, right?

    Does he need to pay for the $1000 penalty?

    We also need help on filling out some items on the forms, like the I-765, it’s asking what’s the current status, do we need to specify “out of status” or is there another term to use? And on the I-130, it’s asking for the I-94# but he doesn’t have it anymore because they took it when he came here to the U.S. and they just stamped off his passport as Immigrant (CR-2).

    Need help please!!!

    To be honest with you, your situation is kinna tricky... I would contact a lawyer to help because they could assist you throughout the whole process.
