Hey guys and gals I really need some help here. My I-130 was approved and we were all excited, only to recieve a letter today saying our I-485 was denied. The economy has been crap, and I didn't make the poverty line to sponsor my wife. The letter said she has 30 days to leave the country or she will be deported. We are freaking out! However I was doing some research and I read you can get a co-sponsor to cover the income portion of the requirements. Is that true? What's the name of the form? Little background, my wife is English, I'm American my whole family are American citizens. Both my parents (her in-laws) are way above the poverty line. Can we file an appeal? A six-hundred some odd dollar appeal I'll have you, but we'll pay it if this is at all a possibility. My wife is making plans to move us back to the UK, I'm hoping there is another option, once again I'm looking for someone here to give us an answer. Please help.

Hello, So sorry to hear about the denial .. but don't loose hope , take this as a challenge and fight it out. Yes, you can find a co-sponsor. I suggest you read the instructions on forms I-130 and I-864 (affidavit of support). I 864 should have an option for co-sponsorship. Read the instructions very carefully . I have read (in forums) of people re-opening their cases.

Silly mistake
Hello how can you make such a silly mistake when you could have gotten a family member or a friend to co-sponsor you or your wife, anyway it is not too late, get a co-sponsor ( to sign the I-864-affidavit of support) then you need to file a motion to reopen( with payment) this will keep your case open when granted and also in the interim will keep your wife in status but she cannot work i.e it will buy you time( usually it will take about 6months to have a MTR adudicated) meanwhile file a new I-485 for your wife with your co-sponsor( I-864), the new 485 will be adudicated faster than the MTR. You will then have 2 cases with USCIS, they might eventually close one and approve the other if you donot have eligibility issue and do not commit another unpardonable error.
