  • Filling Green card through Marriage

    Hi Everyone,

Here is my Situation.I came to US in jan 2007 on Student Visa. Currently I am on 17 month OPT extension. I met my spouse(girlfriend) in july 2008. I recentlyu got married in march 2011.Currenly I am working in IT. Now I am Planning to file green card and work authorization.
My OPT going to expire in July 7,2011.Do I need to hire Attorney?
I am very nerious about that. There are so some documents require and I can't get it soon.
They need the address proof. I Just recently add my spouse name into my bank account and I will get the Statement stated both name in May 20,2011.
We don't have any other proof of commom address.
Other thing is my spouse is not working so my father in law is my co-sponsor but I don't have their Employment letter. I do have their tax returns ,W2, Green card copy and Pay stub.
How to check that my father in law is eligible to be a co-sponsor?
Please guide me that do I proceed in my case?

If you have a co sponsor they just need to be a legal resident here in the US.
Your wife also is your sponsor as she is petitioning for you for AOS.
You will need all this joint proof only at interview right now you need to fill in I-485 along with I-130 and fill in I-864 affidavit of support , one from your wife and one form your father in law. They will also need to supply W2, 1099 and 1040's. Pay stubs and letter of employment yes.
You also need to look up the poverty guidelines on USCIS site to see if you do need a co sponsor. For 2 people household it is $18,387 or 3 people $26.362 .You also need to read as well.

If you go to https://www.immihelp.com/i-864p-pove...it-of-support/ and look up I864p poverty guidelines that will help you.

I would suggest an employment letter from father in law so you don't get and RFE. The more information you have the better it is for you.

An employment letter in not required.

Don't wait on a bank statement. Did you even ask if both names apprear on the statement? My bank doesn't put both names. Ask the bank for a letter stating you are both on the account.

If you just married, it's hard to show much in a joint name. Gather things to take to the interview. Get your driver's licenses at the same address.
