  • Help:Greencard interview without fingerprinting

    Just received a notice that the second fingerprint is denied because it is unclear. Ask me to submit a no-criminal history in 30 days otherwise my greencard app will be denied. However, the greencard interview is already scheduled to be in a few days.

    I wonder: is that possible to have greencard approved in the interview?
    Or is there a danger that the greencard be denied in the interview because of lack of acceptable fingerprint? Should I reschedule the interview?

    No gc until after clearance

    Hello dear you will either have to go to the interview with your police report/clearance if requested or do another FP. And if your police report is not ready by your interview date you will be given RFE to submit it at a specific time frame. Anyway your GC will not be approved until security clearance is received, eligibility issues concerning criminality is cleared.

      Thanks, lionofafrica. Since I lived overseas for several years in the past 5 years, I'll need to obtain some document from overseas thus there will not be enough time and I won't be able to bring the evidence to the interview. So I suppose I will need to go to the interview, they will give me a RFE, then I will need to submit the evidence, and if everything goes well, my GC will be approved without another interview?

        Annill 2011 interview(i-485)

        There is no need to reschedule your interview, you will not be denied until the 30days on the NOID is up and even if you rescheduled and you were unable to submit the RFE by 30 days it will be denied, please check Immigration law/ Adjudicator's manual on USCIS website. This is to say postponing your interview date will not help and in the alternate you can request for more time to provide the police report, it is at the discretion of the district director to grant or deny your request for more time, so either way not attending the interview will not have any bearing on the adjudicator's decision except you are bent on having your I-485 approved during the interview( in which case you can postpone your interview, submit the police report within the 30days given to you and do your interview thereafter) but there is no guarantee that your GC will be approved immediately after the interview.

          If you are presently in the US, you only need to have police report for the areas or states that you have lived in for the last 5years and if it is less than 5 years , for the duration of time you have lived in the states, if for any security reasons USCIS want report for those period you were outside the US, they will do that themselves.

            Really? I thought I have to obtain those oversea "certificate of no criminal record" by myself for the 3 years overseas in the past 5 years. The 2 years within US should be very easy to get and if they want to get it, they can get it themselves. I am almost to the point to arrange some delegation to get people overseas to get that for me(It is very troublesome to do). Did I get it reverse? Thanks for the reply.
