  • Can I-140 be carried over with the new employer??

    I have my labor and I-140 approved from VSC. Waiting for my PD (Nov' 98) to be current.
    If i am laidoff now, what are my options?

    Can i join another company and file I-485 directly, when my PD becomes current, with my LC & I-140 from the previous employer? (Can i avoid LC & I-140 process altogether?)

    Can i use my previous Labor and I-140 to extend my H1 period for an year ( I will be finishing my 6 yr limit in another year or so), in case my PD is not current?

    Please do suggest me ASAP!!

    I think you will ahve to go through the LC and I140 again at your new employer. But, you can use the priority dateof the previous LC and 140 filing, if they are both approved.
