    My friend entered the U.S 25 yrs ago from his home country of Guatemala. During the past 25 yrs he has been married to a U.S. citizen and then divorced. He now has a significant other who is also a U.S. citizen. They have been together for 10 yrs and have 2 children. My friends father is in the U.S. and also a Citizen. His mother never married this father and he took his mothers surname. Since his father was not married to his mother, his name is not on the birth certificate. Remarkable during the last 25 yrs my friend had never had a lawful permanent resident status. He does however still hold his original passport from Guatemala. He did apply for LPR status with his ex-wife but never completed the processs and thus the application was denied. Now he wants to apply for LPR status. What are his options? Can his significant othert apply for him given that they have been living together for 10 yrs and have children together?. Or can his clildren apply for him? What about his father can he aaply for him? Or will he have to retutn to Guatemala to obtain an immigrant visa? PLEASE HELP!

      If your friend entered US illegally and there is no way he can legal in US. If he leaves US, he will have a ban for 10 years.
      I may suggest you to speak to an experience attorney who offers free consultation. Post his/her advise here and go from there.
