Hi...
I am presently employed with company ABC for last 5 years. Last year I came to US on L1A for my current company. I am due to return to India after I complete my assignment in December 2011.
Company XYZ approached me, they want to file H1B for me. If they file H1B, and the same gets approved, I have the following questions:
1) How long does it take for a Change of Status from L1A to H1B once H1B is approved?
2) Since I'm transferred to US, will the notice period of US or India be applicable since they are different for my company in the two countries?
3) If my company doesn't release me that is approve my resignation, can I just resign and start working for company XYZ, provided my COS is approved?
4) If I go back to India, while I am working on this changed status (H1B), do I need to go for H1B stamping again to return back to US?
