  • Late aos application - help

    Hi everyone!

    I got married last week of April of this year, but since the certificate will be available after 10days, it will take 2 weeks before we can have a copy. My K1 visa will expire May13th and my husband is out for a business trip and he will be back May14th. I am worried if this will be a problem if we get to file the AOS a few days after my visa expires.

    Please give me some advise.

    Just so you know your K1 visa expired the day you arrived in USA. You are talking about your I-94 expiring the card they gave you on the plane and is put in your passport? Don't worry you are fine to do AOS when your husband gets back Friday.

      hey Barbara,

      It's you again! you helped me understand everything with the process before when I was still working on my K1 application and now I am already here and working on for AOS processing and it's you I'm so happy

      Thank you by the way for your reply, however, I have another question, what if I already got my temp green card or advance parole (while waiting for my AOS application get it done by uscis) to exit US and re-enter is again, can I use the same passport? since the K1 visa was no longer valid and how many times can I use the parole to re-enter the US, cause we are planning to go back to the Philippines to see my parents the end of this year before our church wedding and then go to Ireland after the wedding.

      so what I'm trying to say is that is it possible to exit the US more than 1 time using the advance parole?

        Ok when you apply for AOS you will send in AP form and EAD form as the fees are waived when sent in with AOS. You could not have a GC only if you entered USA with spousal visa. When you send in AOS application with your AP advance parole and EAD work authority. This will take approx 2 months and in that time you will have biometrics, (fingerprinting done and photo taken). Now they have updated the EAD and AP as they are combined together on 1 card now, not separate any more. It is a new card with both EAD and AP on it. You most probably wont need to use AP as you should have GC well and truly before the end of the year and that's all you need to travel with and re enter the USA.
        If you need to use AP then yes I believe you can use it 2 times only. But doubt you will need it darl and I am glad I can help. Your GC AOS should take approx 4 months and if it goes to Cal office you may not need an interview as mine did and we did not have interview. YAY me as I have my GC now.

          First of all congratulations that you already have your GC.

          Based in your message, It's better to send all application forms at the same time to save money for paying the fees individually, thanks for the TIP!

          You said the AP/EAD will be combined in 1 ID card, will this be release faster than the AOS application gets approved and issue a GC?

          Also I wanted to know since I am already married will they automatically print my name on my ID card and GC my married name or my name before I got married will still be the name they put on my ID and GC?

          I'm kinda wondering if how this work, my foreigh passport will still show my name before I got married and if they issue an ID with my married name, how is that going to work in the immigration if I plan to exit the US for a few weeks.

          I'm in Chicago now and my application will definitely go to California, so do you think I will not get an interview as well? Where you from the US anyway?

            Uni you fill out AOS in the name you want to use and go by and if that's is your married name then you write everything in your married name. Your AP and EAD card will come in your married name if that's what you use and your GC will be the same. My previous name was McDonald and now is Linwood my new married name. so all my cards are in my married name Linwood same as my SSN. If you want to travel after you get GC you can still use your passport in old name you just have to book the tickets in name on passport and carry marriage certificate with you and GC. I have already changed my name on my passport with Australian consulate in Atlanta. I had to apply for name change in my own country first and then I was able to get my passport name changed to Linwood.
            I hope this helps you and you can understand what I am saying ok .
