    Hello All,
    I am in the process of getting this ball rolling with an AOS for my wife from Canada. She is currently here in the states, came over as a visitor and we made the decision to get married after I had been in Canada for over a year. We now reside together in a household with family (2 other members) and they are willing to assist in the sponsorship of her (making well over the poverty guidelines set out by USCIS).
    My question is this, Do I send out the I-130 first and *then* the I-485? or Do I send them both or put a lag time of a few days between them? That is the only part that is confounding me at the moment. Which way to file them? We've already got evidence together and paperwork in order. Thanks so much!

    How long have you been married? I am asking this question because in order to gain immigration benefits, you have to be married for at least 90 days!

    Sure you can file I-130 ($420) first and then I-485 ($1070). Additional benefits if needed: I-765 ( Employment authorization) at $360 and I-131 at $360)travel document! ( waste of time also)
    But here a great dial with USCIS: do the package( I-130+ I-485+ I-765 + I-131 (travel document in case you need to travel while the case is pending: this is recommended for Legal immigrant only during adjustment). The whole package at the cost of $1070 if filed all together, and it save time in process!The advantage of doing this together is that you pay the same price as you do I-485 by it self! I believe doing the package is BETTER! Good luck to you guys!

      I didn't think that the fee was all inclusive for all of those papers, except for the work authorization. I can file the whole package, no problem, at once. We've been married since the 17th of March, so as of the 15th of June it will be 90 days. Her 180 allowed days will be over on the 28th of june. Is this going to become a huge deal causing a deportation order or some such? Or will just having gotten the papers out and to the lockbox be enough to prevent any sort of problems?

          If you want to file all of these forms concurrently (together) you still need to pay the fee for the form I-130 and I-485. The rest of the fees for the other forms are waived. I would suggest that you file concurrently that's what I did for my wife and everything is been going smoothly so far.

            I was planning on the concurrent if I could do it. As for the fees, I planned on paying them all anyway, because I really don't want to have any issues with unpaid fees etc. It's nerve wracking, yes, but worth it and so much more. The only problem I could foresee is a lack of a joint checking account or some such, since we are living with Family (who is sponsoring her with me) and due to some bad financial issues, I am unable to have a checking account to put her on and all the utilities are paid etc. Any suggestions for this? Thanks all.

              like I told you you could avoid all of the other fees except for those two that i mentioned earlier. If you read the instructions for the form I-485 it says right there the fees of what forms you can avoid. And for the bills you could put the excuse that there is no social so it is really hard to add someone without social to your bills and bank accounts.

                Thanks and I will go back over that part again when I am more awake...I appreciate the help and the advice from everyone, I know this will work out, it is just a matter of time, money and formalities.

                  One suggestion because I see some problem with your case: lack of joint account, and what? consult a lawyer: consultation fees to pay only; then ask all your questions and see what he will tell you! Then, you can send your application by yourself if you want to. I do that some times to get on track. I believe lawyer advise is much better in some circumstances, since each person is different and has it own case! Immigration process can be very complicated! And mostly, making a little mistake at the very first time of filing the application can cause to spend much more money. I wish you all the best.
