  • Evidence Concern

I'm American and my husband is Australian (we married in the USA) and we're going to be filing (with a lawyer) so he can live in the USA with me.

I'm really concern about the lack of evidence we have BEFORE he came out here to visit me in person. We rarely talked on the phone due to the fact that the cost per a minute was almost a dollar. We have no emails or chat logs because we used voice chat programs (Vent, Mumble, Skype) to talk to each other. I mean I do have a few chat logs, but they're not very informative since we did all our talking over voice chat.

When he did come to visit me he was here for 3 months and I went back to Australia with him for 3 months to get to know and spend time with his family. We have a few pictures but not a lot as me and my husband and I do not like being in pictures. After 3 months of being in Australia he came back to America (for 3 months again) with me and we started talking about whether or not we wanted to get married. Finally after 2 months we just decided and did it.

It is a real marriage and a real relationship out of love, I just feel like we're lacking physical evidence that might cause some issues. I mean we lived and done EVERYTHING together for 8 months (almost 9 now) straight. Shouldn't that alone be enough proof that this is a real marriage/relationship?

You are applying for CR1? DO you have any witnesses to your marriage? Photos of that? As far as skype logs and chat not sure if you need to use them. Utilities, car insurance rego, bank accounts and so on. You have a marriage certificate yes? As long as your marriage is real then you have nothing to worry about, just use the chat logs you have and use the pics you have. You don't need a lawyer save your money you can do this on your own. If you can get a few affadavits notarised from friends of your marriage can help also.

If you live together: evidence as marriage license and joint accounts:bank, bills, rent or mortgage, income taxes, assurance card, or children birth certificate if any, and of course some pictures, statements from families, friends and even co-workers knowing you together as spouses, movie tickets, airplane tickets or vacations proof if you have some! Anything that may show you as couple physically; USCIS does not take "Love" and emails as proof since anyone can create them...If you don't have these evidences, you may have to wait until you get something. Such evidences are strongly recommended to make your case easier and successful!
      Good luck to you all!
