  • AOS Interview - No Decision

    Hello everyone,

I have to start my showing gratitude to this forum. I have learned more here than I would have learned from an attorney. Sincere advices from experiences, and pretty fast at that.

I'm married to a US citizen and I'd have 2 yrs in the marriage in August. Filed for adjustment of status in Feb 2011, had my interview on May 19. After my wife and I were sworn in, and info that we submitted in the forms verified, the IO asked me to excuse her so she would talk to my wife. Then I was called in, asked a few questions (Identical to the ones my wife was asked). The Officer told me that the doctor had not completed some parts on my medical form. I was asked to take that for it to be completed and returned. No decision as to whether I was approved or not. The IO gave me a letter about Section 216 of Nationality & Immigration Act, which explains that: You will be given 2 yrs of conditional residence if you have not had 2 yrs in the marriage. My passport had not been stamped, nor was my EAD taken. She detached my I-94 from the passport and said "you wouldnt be needing it anyways since it's expired". So I took the medical form back to the Dr on Monday May 23, completed, sealed and returned. Delivered on May 24th. Its been 11 days since the medical has been returned/delivered. There has not been any update on status when I check online.
Has anyone been in a situation like this? Or even just familiar with it and how did it end up?

    Thanks

mm as you have sent everything back you should be fine could take a month for you to hear anything after they receive your medical. Hang in there and if you don't hear within the next 2 weeks you will need to call.

Thank you. I guess I'm just more nervous than anything. Whats confusing is the inability to understand the mixed signals from the IO. Didn't show any hints of rejection or acceptance but took the trouble to explain and make me sign the 2yr conditional residence and the removal of the condition steps after the 2yrs.

Well I suppose they are trained not to show any emotion whatsoever as they could not get involved in all cases and then again they must see so many cases and not so nice ones too so I can imagine they would not show too much emotion or attitude . They just needed the medical is all.

          AOS Interview - No Decision

          Hello people,
I am beginning to be worried now. I have had my AOS interview on May 19 and still haven't had a decision. I made 2 info pass appointments and on both occasions, I have been told that "the case is still under review". The last one, which was a couple of weeks ago, I was told to check back in 6month. Has anyone ever been in similar circumstance? What are my options, if any?
