  • worked w/o EAD using SS. Now time to file I-140/485???

    My company is filing my I-140/485 concurrently and the company lawyer has asked me to send last 3 years of tax records and W-2s. I have filed taxes but the problem is I have worked without EAD just using my social security during this time. Am I in big problem due to this or is their a way around this. Anyone had similar issue.
    My main concern is does the USCIS need the tax return as part of the application or is it just something the company lawyer needs just in case.

    Yes, you need proof that you had worked accordingly to your visa. Not sure what type of status you used to have. But if you had a working visa or permit for a specific company, you need proof through your taxes that you worked for that company and they will ask you for copies of your paidchecks as well. If you didn’t definitely it will be a problem when filling for an adjustment.

    BTW if you are out of status you cannot file for an adjustment.

      earlier I was in F-1 status when I worked without authorization. Now I am in H1B status.
