  • Regarding my mom

Hi immi help. This forum has been very useful to me and I cant thank you enough for the support and help this website has given me.
My mother is here with me on visit visa. She visited me last year also but now I am a US citizen and want to file for my mother's green card. I am not currently working but am looking for a job so that I can provide supporting docs but right now I have to ask my hubby for sponsor/ supporting documents. On the other hand my husband is looking to sponsor his parents too who are in India. Kindly advice how strong is my case and which is better to first file I-130 for my mom and then file i-485 (adjustment of status) after receipt of i-130 or to file both forms simultaneously (concurrent filing)

Your advice will be very helpful.
    Thanks

If she is here you can file concurrently! Are you talking about your mom came to visit and stay? My question is: what is her status now? overstay or legal? It is important that you understand immigration can see it as "intent to stay" as your mom came to visit! My advice is to consult a lawyer to make sure you are on the right path of process before applying. All the best to you!

Thanks for your reply. Yes my mother is currently on visit visa. Its not overstay. Her 6 months stay period expires in november and she has a return ticket. Its a 5 years multiple visa. Out of whcih 3 years is left. But we have heard from various sources that since I am a citizen now she can apply for her adjustment of status and get a green card being in USA.
      Please advice.
      Thanks
