  • Questions about AOS Interview

    Hi!
    I married with my US citizen wife in march this year. We want to apply for my AOS (I overstayed my J1 visa for about 2 years). She has a 7 years daughter (US citizen also) from her previous marriage, she got divorced 2 years ago. When she apply for my AOS does she needs to include the daughter in the form too? Should we bring the daughter with us to the AOS interview? Does the USCIS require in general to bring the children at the interview (she is a USCitizen)?

    Yes she can apply for you! Of course she will include her daughter because there is a part in the application that requires to list children, their birth, and location they were born ( regardless their nationality). I don't think you need to bring the daughter to the interview ( unless immigration asks you). Never hear that children call for interview about parents or step parents! Good luck.

      She also has been married with the father of her daughter and she applied for his AOS 3 years ago. Does this one will be a problem and will raises a lot of suspicion and scrutiny for my AOS or at AOS interview? We also want to visit my country to see my parents if everything will be fine after the interview.

          Divorce and marriage are part of life, aren't they? If you have the proof that you entered in a faithful marriage with her, I don't see any problem! Just be yourselves and tell the truth because lying is the source of issues to "Immigration eyes"! Good luck

            While indeed getting married and getting divorced are things that happen, looks like your current wife has a story of marrying foreign citizens & then applying for AOS for them. Which may be perfectly OK - but some things that you and her may be asked during your interview/things that will be looked at:

            a) if she has a birth certificate for her daughter with her previous husband's name on it
            b) how long she remained married to her previous husband after AOS and before divorce
            c) how long you knew her for before getting married

            You (and specially her) will need to overcome the assumption that she's doing this for money all the time, or that she's doing it for money now.

            Sorry to be blunt - it is what it is.

                blunt is not rude. The same comments I made are going to go through the mind of the person performing the interview.

                Cops don't yell "pretty please, with sugar on top - Mr Criminal, could you leave your handgun on the floor? Being careful not to scratch it, of course. That would bring me peace of mind and would be a big step in the solution of this problem". They yell "DROP YOUR GUN". Short and to the point.

                If in the future you don't like one of my comments, feel free to send me a private message. The only person here with any rights (if so he wanted) to be offended would be the person who asked the question originally.

                  Sounds like good advice and to the point not rude mickey has a point seems this is exactly what the person looking over the docs and running the interview are going to think......
