    My wife is here in the States illegal, she was caught crossing the border about 5 yrs ago after coming back from her fathers funeral. She was sent back on a voluntary basis and never signed any forms. They did take her finger prints and flew her back to Mexico city. We have a 2 yr old daughter that was born in the States. I am a US citizen, I am on SSD due to PTS and a heart attack. I am on medication and see my Psychiatrist on a monthly basis. We have lived together for about 10 years and got married Dec 2010. My understanding is it will be almost imposable to get her legalized even through a hardship. I have been told that if she is ever caught here in the States that they would deport her back to Mexico. On my income it would be almost imposable to be able to support her in Mexico while my daughter and I live in the States. It would put a real burden on me trying to raise my 2 year old by myself due to my age (61 yrs old) and health. My wife is 30 years old and not only is she my wife she is my life, partner and unlicensed nurse.We do not want to move to Mexico due to the corruption and drug problems and we want are daughter to be able to get a good education. I do not want to leave my family from my previous marriage. I have hired a lawyer and he has run a FBI background check on her and just received it, we will be meeting him next month. He tells us that it will be almost imposable to get her a visa. My question is do you think that we will be able to get my wife a visa without leaving the States or just get her a visa? I have a feeling that our lawyer is telling us how hard it will be to get her a visa because he wants $6500. I think (hope) he is just saying this to make us think that it is worth all this money to get her approved. Has anyone run into this and what was the out come? any advice or input will be appreciated. Thanks grm

      The only way for you with this history, is for your wife to move to one of the La Familia or Sinaloa or La Zetas controlled state( have an official address in this area). These are dangerous state that US Citizens are warned against travelling to and not encouraged to live by the State Department, with this evidence in hand you can apply for hardship and since you cannot not go and live in those states with your wife and your American Citizen child plus your health related issues ( PTSD, S/P Heart attack). Another way is for your wife to establish residency in this drug Lord controlled territories with multiple mass graves( documented in the papers), she will have to find her way back into the country by whatever means, file for AOS, it will be denied because of her record, you will appeal( this will take years, meanwhile she will have work authorization while in deportation hearing-get a good lawyer because it is doable- to get a work authorization while in deportation hearing- this hearing may take an average period of 3-5years, of which she will be able to suport the family and her child economically). At the end of several years of hearing before the court, she will be granted a waiver based on hardship, inability to go and live in La Familia, La Zetas or Sinaloa controlled territories. It is going to be a long walk, but she has to find her way to the USA First, to be able to make avail of the generosity and the santuary of USA.

        My question is how did she get back after being deported? If I understood, she came back after she was sent 5 years ago? The response matters in this case. Somehow, the lawyer is right: once one got deported ( and especially caught on the border); it will be quite impossible to fix that, BUT I BELIEVE WITH ALL THESE SITUATIONS THAT YOU EXPLAINED, something should be done: "hardship." Please clarify about your wife: How did she get back after her deportation in order for me to guide you! For now don't let your wife leave the country ( USA) at all!!! Good luck.

          I personally doubt that there is a solution for her immigration situation. Its worth a try but a very very long road. I am pretty sure that a work permit will NOT be issued in her case situation.

            For now a work permit is not necessary, I am able to support her and my baby with out her working, plus the Social Security Administration said she could draw a check from my SSD check. They told me that if she can get a ss# she could draw from my disability.

              She walked across the desert for two weeks is how she got back. It happens all the time. When she was sent back they give her an option, fly back to your nearest airport to your town or we will take you back to the border. She flew back home to wait on her coyote.

                If she got back here legally (had been inspected by an immigration officer), there will be some chances and hope! But in her situation, it is going to be impossible from what I know the immigration laws said! I am not an expert, neither a lawyer. I agree with Daru786! Give a try; may be someone will help you.
