  • Need Help with I-864 : evidence required

    Hi Everyone,

I file my green card in may. At that time my wife was not working so I got the letter stated that income is not sufficient.
Now My wife start to work from June and she had employment letter mentioning the annual income and when she started.
Can I send the New I-864 to USCIS with employment letter, last three year tax returns and US passport?
we are just 2 me and my wife and letter stated $22,000/per year. It will work or not??
And Do I have to send pay stub too to USCIS or just letter will work.

Thanks in advance for the response.

    Thanks

If USCIS has sent you a "Request for Evidence" letter or RFE, the list of documents required to submit with your petition will clearly be stated. The norm is to send a letter of employment with the dates of employment, annual wage , position in the company in addition to a few recent pay stubs and tax returns of 3 most recent years. However, please check your RFE for details or contact the USCIS customer service and ask them if your call could be escalated. If you have not received an RFE, then address this concern to USCIS when you talk to them.

      Thanks for really quick response.

I checked the REF document; It stated Below:

you will need to file Form I-864,provide copies of most recent federal income tax returns, all supporting tax documents(W-2s,1099s, and tax schedules) and evidence of their status as united states citizen, unites states national, or lawful permanent resident.

They didn't mentioned pay stub and even I don't have it. Is it ok to send the documents without pay stub??

      Thanks

Well, if that is the exact list of documents you are required to send, then be confident and just do it. If they need additional documents, you will receive a "request for evidence". The USCIS website will clearly state additional information on the I 864. Basically, the whole point of I-864 is for the applicant to prove that he/she will be financially taken care of by the petitioner and/or himself/herself and not be a liability on the government. You can obtain proof of funds from multiple sources, your spouse, yourself, other family..as long as you show adequate documentation and your established relationship to your sponsor(s). This said, I highly recommend you calling USCIS to reconfirm the check-list before mailing out anything. Also, Do not send originals ..only photocopies of everything.
