  • U.S. Citizen, marring Thai citizen on work visa

    Hello, I am a U.S. Citizen and I recently married a Thai national of whom entered the U.S. via a work visa (J1). That visa expired June of last year (we married June of this year).

    I've filled out the i-130 but believe I need to fill out an i-485 as well? I've seen a few variants which don't seem to apply to her status, so now I'm not certain if I'm supposed to file one at all?

    Can someone point me in the right direction? I'm sure this has been answered here before but I'm not having any luck with my searches.

    EDIT: Additionally, I've read that other documents should accompany these forums? Like birth / marriage cert. anything else?

    I think I found my answer after some searching on the web.

    I should fill out the I-130 and I-485. I will select option "h" on the 485 and state that an immediate relative petition is being filed concurrently with this one (or something to that nature).

      Yes you are correct 239 and 485 with accompanying documents. make sure you read the guides thoroughly
