  • I-140 approved but may be laid off please help??

    I may be in trouble. I filed my GC in EB1B category. MY I-140 is approved and I also got FP done for I-485 which is now pending less than 180 days. I have also applied for EAD/AP simultaneously. My company may be taken over which may affect my job. In this scenario what shall I do.

    1. If I get EAD can I change employer without affecting my GC process
    2. Or shall I keep waiting till my GC is approved. If employer still exists it will be ok. If not, what is my option.

    I hope my I-140 may not be revoked anyhow. On other hand my H1B is still valid for 2 more years. So its not like my H1B visa is beyond 6 years

    Guys please help and suggest how does USCIS views this

    1. No.
    2. Keep working for them as long as you can. If your I-485 is pending for more than 180 days when you leave them, you can port them to another willing employer through AC-21. Otherwise, bad luck, as you will have to start all over again.

      Thanks for response. But if I am not hired by takeover company (before 180 days of my I-485 application) I have to look for a new job. Is it ok to move with EAD
