Questions about GC for parents

    All,

    I am readying the application for a GC for my parents and have a few questions pertaining to it:

    1. I do not have a birth certificate for my mom or dad.
    -For my mom, I have a signed affidavit from her mother on a non-judicial stamp paper and a school leaving certificate that mentions her birth date.
    -For my dad, I have a non availability of certificate from the municipality and a school leaving certificate that mentions his birth date.

    I know a birth certificate or at least a non availability certificate is required, but have you or do you know anyone who has applied without it? Will it be a big problem?

    2. Since I'm submitting separate applications for both, can I use form I864EZ for each?

    3. They are currently in the US on a visitor's visa. I've been told by someone that I should wait at least 90 days before I submit their application.

    4. If they get an Advance Parole, can they go to India for a few days before returning?

    I just realized that I asked the second question earlier and the answer to that is "yes". I would appreciate it if someone could answer my other questions.

      See what I don't understand is how you can file AOS for your parents when they are only here on a visitors visa which is a non immigrant visa?
      Are you a USC? I presume you have filled a 130 as well? You have been told to wait 90 days because it will be looked at as fraud if they entered here on non immigrant visa with the intent to stay and adjust status so soon. Was this the intention to begin with?

        Yes, I am a USC. I have not filed anything so far. I am planning to concurrently file the I130 and I485 ( which technically they will be filing) I plan to file two separate applications, one for each parent.
