Have a I485 question

Hi,

My Priority date is current by Nov bulletin and have a approved I140.

Plan to get married early next year Jan2012 and My fiance/wife can come to USA ( given gets VISA and all in a week) in Feb2012 for a month as she is in final year Btech so have to get back to India by early march and will be in USA by May2012 for good.


If I plan Apply/process I485 in Feb2012 when she is here for a month what are the issues I might face ?

or Is it a safe bet to Apply/process my I485 in May2012.

My H1 expires in Sep2012 next year too

Any Ideas are hugely appreciated.

Provided you are already married to her when she visits the U.S., and if she applies for I-485 while here, unless she is on H4 visa, she will have to get advance parole in order to return to the U.S.

I don't see any reason to delay the filing. However, make sure that you get married BEFORE your I-485 gets approved.
