I-130 form doubts

  • I-130 form doubts

    I came on an exchange visitor visa, and last july I married and US citizen. we are filing the inmigration form but I'm not sure if we both need to file separate I-130 forms. Does anybody know what should we do?

    You only need to file I-130 for yourself and not for your US citizen spouse.

    However, make sure that you are not subject to two years home country residence requirement. If you are, make sure to get the waiver first.

      I believe her husband needs to file the I-130 for her as beneficiary...........
      Also an I-485.
