  • AOS Interview Results -- Help!

    So we had the AOS interview, and it went fairly well in the area of establishing the bonafides of the marriage. However, there is some question as to my eligibility to sponsor my wife due to some historical items that have happened in years past (I decline to make any comment on it publicly). I am in the process of providing paperwork to the Officer that will be making a decision based on it. He was fairly tight lipped about what options we might have available if he denies the application based of me not being eligible to sponsor my wife due to these historical happenings.

    What are our options? We have a co-sponsor whose eligibility is not even questionable in the least. Can this help us? Or are we going to have to start the process all over based on another application totally? Help, as I am sure you can imagine we are both under a tremendous amount of stress right now with this. Thank you in advance.

      We have one and if I need I can have more, and we have had one from the start. This is a visa application based on Marriage to me though.

        You are the USC? yes and you are AOSing for your wife yes? You have a co sponsor yes? Then use them if your finances don't meet 125% poverty guidelines.
        Did you bring your now wife here on K1 visa?

          It isn't financially related. I am the US Citizen. There were some questions about my legal eligibility based on something that happened in my past. I can only state that we are trying to adjust her status based on her marriage to me. We have proven the bonafides of the marriage, however, due to a legal issue in my past, he is stating I might not be eligible to sponsor her.

            Well we are not lawyers here and if there is something from your past that says you are not eligible to sponsor here then you may need legal advice.
