  • Filing I-485 from India

    Need Attorney's help.
My company filed GC in EB2 with PD May 21 2008 for me.
    My I140 got approved later.
I moved to India after my I140 approved, not extended H1.
I had not initiated CP when i moved to india.
Can I apply for I485 when my PD is current from India?
If i can file I485 from India, Do i have to apply for EAD, AP later?
When and how can I go back to USA to work?
Will I have to be with GC filed employer till Naturalization complete?

I'm not an attorney but I do not think that you will be able to use the I-485 to adjust status if you are living outside of the US.

You can't file AOS outside the US as you have to show residence there, this is for a GC to be living in the US not outside it.

Need to go back to USA

As I mentioned in this thread, I moved to india in 2010. My company didn't process my H1. Now I have my company 140 approved. They are asking me to come USA with another companies H1. I know it's completely a fresh start. Is there any way can I use the approved 140 to get my H1 extension with new company for 3 years? Also my company is willing to give all the documentation and let me do process my 485 once i get USA.
