  • AOS interview 11.16.2011 with criminal charges pending

    Hi everyone,

We finally had our AOS interview today and wanted to share our experience.

I came to the US on a J1 student visa and married a US citizen, then applied for AOS (green card). Neither of us have a criminal history and we used a co-sponsor to meet the minimum income requirement.

After we applied and while the application was pending, I was involved in a very unfortunate incident and was falsely accused of a crime I DID NOT commit. Although my attorney is very confident all charges will be dismissed, I was nervous about the interview because of the pending charges.

As advised by my attorney I wrote a letter to USCIS informing them of the charges, this is mainly because when I applied for AOS I answered "NO" to the question about ever being arrested which was true at the time but obviously changed after the unfortunate incident I experienced.

The interview lasted approximately 30-40minutes and the officer was VERY professional and VERY helpful. Don't get me wrong, the officer asked a lot of questions about our marriage but the officer made it a very pleasant experience.

In the end the officer said they are convinced our marriage is bonafide, but cannot issue a green card until my case is resolved.

The i-130 was approved, but i-485 will remain pending until my case is resolved. I will have to go back and submit an original copy of the case dismissal notice once the case is dismissed and they will issue the green card.

This was a GREAT and unexpected outcome.

Just some advice, please take as MUCH documentation as possible to prove your marriage is bonafide (real). Joint bills, pictures, affidavits from friends, documents showing the same address...anything you can will help.

I was very reluctant to tell USCIS about my pending charges, because I assumed I would be facing an automatic denial...but I'm very glad I was honest about it.

Honesty is the best policy people!!

Also, pray to God for his blessings on the day, that will also help .
I hope this helps, GOODLUCK and remember...you will be approved
