  • Own A business - can I sponsor myself??

    Hi!
    My wife dont make enough so she could be my sponsor,
    so I heard I will need to get a joint sponsor.
    since I cant find anyone who is willing to do it,
    and also I own A business so i am able to support myself (dont work in it, just own it, which somehow it is perfectly legal for me to do), is it possible to somehow not need to file an affidavit of support form?
    I searched the web and couldnt find any way around it, but
    I thought maybe somebody here knows... I already delayed sending in
    my change of status for more than 6 month because of that....

    Any help will be greatly appreciated..!

      Immihelp is right. There is no way around that form. But its not as impossible to do as you may think.

      The business that you are operating, is it turning over significant profits? If so, do you have all the expense receipts, bank statements, and tax papers to prove it? If the answer to these questions is yes then one option is to legally amend the business' ownership so that your wife becomes co-owner. Then she may be able to use the business income and property on the optional "assets" section of the i-864 form. Or, your can transfer some of the business profits into her personal bank account so that she can use that as an asset. If you don't want to do either of these things then you yourself can use your personal assets (cash, stock, bonds, property, whatever) and your business assets to co-sponsor yourself to meet the I-864 requirements. In this case you would fill out Section 7, questions 27, 28, and 29 on the I-864 and you would also need to file it together with form I-864A (which you would fill out). This isn't the same thing as sponsoring yourself (which you asked). Of course there are conditions (you didn't think that USCIS would make this easy, did you?). Both you and your spouse must reside together at the same address to do this, and you will need to show reasonable evidence that the business is legitimate and that you didn't start it up just to use it for this purpose. There are other rules, exceptions, and restrictions on how this can be done. Read the instructions for I-864A, it explains how you (as the spouse being sponsored) can do it.

      Another option would be for your wife to get another job that pays enough to bring her income up to meet whatever the difference is between her current income and the income requirement that CIS wants to see. She would only have to work the other job for about 2 months before you file because CIS will ask for the last two months of pay check stubs as part of the proof of income from your sponsor if he or she is employed. I know somebody who actually did this and it worked.
