    Hi all,

    I've entered US in 2004 with J1 visa, visa expired june 2005 and i've been out of status, this year married to US citizen. I filed I485 in August, got my EAD , now waiting the interview. I did not apply Advance Parole along with I485 and EAD because my lawyer says I can't apply untill i get the EAD. Now I have an emergency and have to travel outside of the US. My question is, am I eligible to apply for AP? Is AP safe? Does it guarantee entry? My concern is that i've been out of status and afraid that i can't reenter US. Anyone have this experience pls help..

    You should have applied for AP with the 485 as the fee is waived but now you will have to pay for it separate and it will take another 2 months or so so as you already have your EAD and you are awaiting interview I would strongly suggest you stay put and wait for GC .You can't got anywhere without the AP and not sure how quick you want to go but you may have your GC in the time you apply for AP card,

      do you think i can come back USA with no problem after obtaining AP even i was undocumented for 6 years?
