I-485 help

Hi Guys,

Me and my wife have our own independent H-1B visa. My wife's I-140 got approved. The question is can I apply for adjustment of status as a dependent or does she need to file I-130? Any help is much appreciated.

Hi there and happy holidays,
I would strongly suggest you to apply as an independent for the adjustment, and as long as you both in the country - no need for I-130 to file. Just file I-485 for you separately as dependent (I765; I131 if need to travel) and submit with a separate check foe each applicat.
You keep you H1B until you get the greencard in the mail.
