Hey Guys, my PD is current in Jan bulletin.
I (H1) am planning to file 485/EAD/AP by mid-January but my spouse (H4) who is currently in India due to medical emergency in Family won't be physically in US until late February. As a result of this she won't be able to file along with me.
Lawyer said that once she comes back in Feb they can filer her in March. This is all true ONLY **If my PD still stays current in next two bulletins**
However, my concern is what if the PD retrogress after my I-485/EAD/AP filing and before she arrives US. Lets says my PD does not become current again in next 8 - 10 months and I get my GC.
1) Won't my wife be out of status in US ?
2) Can she still maintain her H4 if I have GC?
3) I asked lawyer to wait for my filing until my wife arrives US so that we can file together but he said if the PD is retrogress in next bulletin or so, they will have to file mine even though wife is abroad.
I just want to make she does not loose her status under any worst case scenario.
Please advise.
