  • While filing 485, do I need to apply for OPT?

I am currently on F1 visa and my course is completed on 20th of this December 2011 and now I have 60 days grace period to apply for OPT (i.e., I can apply for OPT before FEB 17th 2012. )

My husband green card dates are current and he is going to file 485 for both of us in the first week of JAN 2012.
My question is do I still have to apply for OPT for maintaining my status or my husband filing 485( for green card )is enough for me to be in status?

So Do I need to apply for OPT or not?

    Hi,

I was in a similar situation myself. If you would like to start working in the "field related to your major", you can apply for OPT along with your I-485. Alternatively, you could file form i-765 which if granted will give you a permission to work anywhere in the US.
If your only reason to apply for OPT was to extend your status, they you don't need to do it if you file i-485. As soon as you receive a receipt and confirmation from the USCIS that they are processing your case, you can stay in the States until the decision on your case is made.
    Hope this helps!
