  • Parents green card - how to respond to birth certificate RFE

    This question has perhaps been asked several times before and so I apologize for one more post but I wanted to explain my unique situation as well.

    I filed the green applications for my parents (I am a US citizen) a few weeks back and yesterday I received RFEs asking for a copy of their birth certificates (or other supplemental information). The information requested is similar to what you would find on the USCIS web site.

    I am a little confused on how to respond to the RFEs as I had already supplied every possible piece of information when filing their apps. Specifically -

    For my mother (born 1950) for whom no birth certificate is available:
    - Non-availability certificate issued by the panchayat where she was born
    - Copy of her marriage certificate and of her passport

    For my father (born 1939) for whom no birth certificate is available:
    - Panchayat/municipal office refused to issue a non-availability certificate, so a letter signed by my father explaining why no birth certificate is available and also mentioning the refusal of authorities to issue a non-availability certificate.
    - Copy of his passport, marriage certificate, ration card and PAN card showing his full name, date of birth, parents names, place of birth etc
    - Two affidavits from close surviving relatives in India (cousin & elder brother)

    I cannot thinki of anything else I can USCIS (perhaps affidavits in my mother's case). What should I do? What other documents can I submit?

    Should I hire an attorney? Or is the matter straightforward enough for me to handle on my own?

      Thank you for your response. The link offers general guidance on what documents to send. I had filed the original application using the guidance in this link and on the USCIS site.

      Given that I still got an RFE, I am looking for some specific insight into what else they might be looking for. In my post below, I have listed the documents I originally submitted with the app.

        Hello TKrishnan,
        I am in the same boat too. I am sponsoring GC for my father who is 65+. He does not have a birth certificate and he can't get any affidavits from anyone older than him as he is the oldest in the family. He has a non-availability certificate for birth and his 10th standard marks card that just has his date of birth. We had submitted just these two with his application packet.

        Today we got an RFE requesting his birth certificate. Now, how do we respond to this RFE?. Please share your experiences. Thank you in advance.

          I am in a very similar situation. got an RFE for my mother who is born in 1950.
          I have submitted the following:
          - a signed affidavit by her that the birth was not registered
          - mother's school record showing the birth date

          I am not sure what else we need to do here as i won't be able to get the birth certificate.
