Dear all,
Me and my wife are both on H1B as of today. We just submitted our I-485 application with me being primary applicant last week. Now my wife has an oversea job opportunity with departure date of March 3rd, which is just over a month from now on. I have following questions on mind but couldn't find definitive answers elsewhere. Please help.
1) if my wife resign from her current position and go aboard with AP still pending, will the I-485 AOS application consider abandoned? If so, is there a way to avoid abandonment? For example, file a AOS from H1b to H4 or apply a H4 visa aboard?
2) Can I mail her approved AP later on for re-entry? or she needs a valid H4 visa?
3) If she uses a valid H4 visa for re-entry in future, what if by the time she uses it but my I-485 is approved and will she be denied to enter the US because I'm no longer in H1b?
4) Is there a way to expedite the AP processing?
Many thanks.
