  • Birth Certificate Issue

    My priority date is current and I am going to file for 485. I have a perfectly fine birth certificate for my wife and myself (matches sample birth certificate on immihelp) but my lawyer still want me to get affidavits because the birth certificate does not have our mothers' maiden names. I do not think it's necessary but I can easily get birth certificate from our mothers but my lawyer wants 2 affidavits which is hard to get from here since our fathers have deceased and don't have any uncle/aunt in direct relationship that can provide affidavits. Does anybody know if I really need affidavit and if so I need to get from 2 different person?

    Not required.

    There is no concept of putting mother's maiden name in India.

    In the U.S., females keep getting married and divorced and their married name keep changing and only thing is constant is the maiden name and that is why U.S. birth certificates have mother's maiden names.

    Generally, in India, once the female is married, she is married for life.
    Therefore, after marriage, she can just go by her married name.

      Just in case affidavit is required, do you know if 1 is enough or I need to get it from 2 elders?
