  • Does anyone know please?

I am trying to find answer for this question on I-130.

I am a US citizen and filing form I-130 for my husband. However, the question 14b in this form states: " Did you gain permanent resident status through marriage to a U.S. Citizen or lawful permanent resident"?

I actually did obtained a permanent status through my ex-husband in January 2007 but now I am citizen (2 years now). Should I leave it blank since it seems to me that this question refers to previous question talking about permanent resident not US citizen? Please help me to answer this: blank or yes?

If you can help me and put your opinion, we will really appreciated.

    Thank you.

Was your ex husband a USC or PR.? If you are the petioner now, you have to fill it in. You gained your permanent residence through marriage to a USC.

Thanks Chipo1 for your reply. My ex husband was US Citizen. It is still confusing since the question 14 b seems to be related to question 14 (asking about permanent resident) not 13 (US Citizen which I am).

You have to put 'YES' as you got your permanent resident through marriage to a US Citizen. ( Wether he obtain any means doesn't matter) this question is for you only as how you obtain your citizenship.

Don't cofuse yourself, you obtained your PR from married to a US Citizen then after you fulfull your PR conditions, you became a US Citizen.

You have to answer this question. In fact, there are limitations - you would not be eligible to file for your alien spouse if you received your US citizenship based on the marriage to a US citizen, unless 1) it has been over five years since your received your green-card, or 2) you can prove that you had a bona fide marriage.

Let me know if you have additional questions.
