  • USCIS requests for proof of inspection and admission into the US

    Hello,

Currently my husband (US citizen) is petitioning for my green card and, and the USCIS wants to see proof of inspection & admission into the US from a road trip we took together to Canada a couple of years ago.

The USCIS officer that interviewed us said that there should have been a blue stamp given to me by the CBP in my passport, I-94, and or my DS-2019 as well, which for some reason is not there. Actually, I had to mail back my original I-94 to the USCIS a year ago when I switch status from J1 to F1, and I did not make a copy of that I-94.The only inspection and admission stamp that I have is the original one that I got in my passport when I entered as J1 status in 2008 which has “D/S” written on it.

I've tried calling the CBP office at the port of entry that we used to enter the US from that trip, but the officer said they were not able to help. They must have this record in their computer, right? Is it legal for me to ask them to retrieve this information? If so, how should I go about doing it the proper way?

What other documents could I use to satisfy the USCIS's request for my proof of inspection & admission into the US from that particular trip?

    Thank you for your help

Unfortunately that is difficult to prove. The fact that you have an older I-94 with you proves that you don't understand how I-94 works. Read the backside of the I-94. It clearly states that it must be submitted when you leave the US. (Except for short trips to Canada or Mexico) and you should get a new one whenever you return. Not keeping copies of your I-94 is also wrong.
Check with the USCIS if a sworn statement from your fiance/spouse that he/she accompanied you on the way back and that you visited CBP post and got a new I-94.
The I-94 number will be the same as one on your change of status approval notice. (Did you notice that there is an I-94 at the bottom of that?)
This is my opinion and not legal advice.

kabkaba is right, you can find a new I-94 on the botthom of the F1 approval notice. You can file for your new I-94 to USCIS.
