485 Rejected ..Pls advice

Hello All

We applied for 140 , 485 etc in 2007 when dates are current on EB3 .I got EAD cards , AP without 140 approval. Later after 8 months my 140 was rejected ...and 485 too rejected .

After again my company in 2008 applied for new labor on EB3 and 140 got approved .
After again my company in 2011 applied for new labor on EB2 and 140 got approved with porting to 2008 labor. Now we are preparing to apply for 485 in which we have a step to inform if any time we applied for 485 what's the status ..if rejected when and what's the reason. In this section pls advice me if we have to mention my case which is rejected in 2008 which in on EB3 but the current case which we applied in 2012 is on EB2. Pls advice ASAP.

Yes you must have to mentioned previously you applied for I-485 and it got rejected and the reason. You can hide anything from USCIS. The truth works all the time.

This is not a problem, somany peoples applied in 2007 got rejected I-140 and I-485. Mine also got rejected, and it is like your case.
Question about EB2, its ok as you gain more experience from 2007 to 2012 which five years. Your education and experience comes under EB2.

So mention the reason why you got rejected. that's it and apply the current EB2 AOS.
