    My I-130 has just been approved, but I was informed by USCIS that I am not eligible to adjust my status based on the information I presented. I came here on a tourist visa, submitted all the necessary docs with my I-94, so I don't understand why I was not allowed AOS. Although there was a clause which says that if I believe I am eligible, to contact the local USCIS office. I am thinking of doing that (bypassing my lawyer) by myself. Would re-appealing be a good idea?

    Do you have attorney, what he suggest you.

    Did you file your I-485 and I-130 together?
    You might eligible for AOS in the United States. Make infopass and talk to IO.
    It might be good if your attorney represent there.

      I do have a lawyer, and yes I applied the I-130 and I-485 together. The reason why I'd like to do this alone is because I feel my lawyer is nickel and dime-ing me for every little thing. The last two times I met with him, he just talked a bunch of nonsense just to say he counseled me for an hour

        Dude, what you got to do is fill out the AOS paperworkd under the category (c) (9), i came also with tourist visa and i got marry with my wife, and i am just currently waiting for, my priority date to become current, i am from Dominican Republic, and i a friend of i is helping me with this documents, and so far i have my EAD approved for 2 years, i dont have the AP, because is a waste of money, so think about before your redo all the paperwork, try look help with some non profit organization, that helps the immigrants and i know you will be able to get at least the EAD
