Help with a.o.s and sponsor

    Hope someone could help me,i came to usa from uk on a visa waiver 7 years back for a visit my girlfriend at the time and decided i wanted to be with her and never went back ,
    we married 3 months after that and now been married 7 years (we not young people we 60 wife and 50 me now)
    things went wrong soon after with wife lost job and few health issue and over last 7 years been the same with jobs and few health and other things and we could not rise the money for a.o.s papers,
    now my brother in law said he will sponsor me but i am not sure how to go about that ,
    i know i need these forms
    I-485
    I-765
    G-325
    I-864
    I-693 with a medical
    photos etc

    I read i might need this form I-130 bit not sure i understand that one
    any help would be appreciated

    Your brother in law CANNOT sponsor you. Your wife may and you need to file all those forms you mentioned above.

      Your wife can petitioned for you. Your BIL can support you by providing affedavit of support.
      Submitt all the above forms along with I-130 and affidavit of support form.

      Submit marriage certificate and tax transcripts of prevous year. if you/your wife have enough saving to live then you can show to immigration.
      once you submit you will get Employment Authorization card withing 3 months then you can start working.
      After submission you will get finger print notice and an interview letter.
      At the interview be prepare to show all the evidences of your bonafide relationship.
      Like marriage certificate, joint lease/Joint property, joint motor vehicle, insurance on both names, pictures, honey moon trip proof, vacation proof,joint utility bil, joint tax returns, joint bank account etc.
      If you have kids togather.
      Start processing as soon as possible.

        Fortunately what the Daru (poster) answered is not correct. You do NOT have to use your wife for affidavit of support. If your brother in law is willing then go ahead and use him.
        My two sisters who were married used my sister for AOS and did not have a problem. The did not even file it jointly (husband and sister) they simply did one (my sister).

        Anyone can do aos for anyone. I know of friends who do it for each other. The government doesn't care who is responsible as long as someone is.

        If you want t o use your spouse and your brother in law together you can do that too, by having joint sponsOrs if a single income is not enough, but to answer your question directly. YES YOU CAN USE YOUR BROTHER IN LAW.
