    Dear members,

    An immigration lawyer told me that filing I-130 and I-485 together is not legal and the beneficiary can be permanantly deported if caught ? Is that True ?

    That is totally not true, I recently filed all six of my forms together at the chicago lockbox office.

        This is totally wrong. You can file I-130, I-485, I-765, and Advanced Parole (Travel document) together in one packet.
        May be you have some specific reason for that the attorney don’t want to file together or a person staying abroad then they file first I-130 and then submit the documents to national visa center.
        Generally if you are in USA better to submit all the forms together and it is a common practice by the attorneys. I have filed all the above said forms in one packet and everything is fine.

          Please ask them why.

          May be the person came to the U.S. just last week on tourist visa and you filing I-485 now may prove the preconceived intention that the person never intended to enter the U.S. as a tourist.

            I did ask them and they said that the USCIS know that many of the tourists come to the US on tourist visa and then file I-130 along with I- 485 together to expedite the process of getting green card, which is totally illegal. This practice is okay as long as they are not caught that they came with the intention of being an immigrant to begin with. But, once they are caught, then they are deported forever. But again, It is scary in a sense that you never know how to prove your intentions and so forth, just in case if your case become suspicious due to having a bad luck. Its like proving the ties in B1 visa's case, where a lots of well intentioned people get rejected every day !

            I don't know, but keeping the credibility of that particular lawyer in mind, it definitely shakes the confidence !
