  • I-485 RFE, asking evidency for unlawful presense

    Hello,

    RFE says "USCIS records indicate that you were physically present in US prior to your last admission. Submit evidence to establish that you were not in unlawful status in the US between 1997 and 2004."

    But the first time I entered into US was in 2003. Since then I am always on status whether F1 or OPT or H1B. I am guessing USCIS might be confused between my name and somebody else.

    Please suggest what are my options for evidence.

    Hi, Write a letter to USCIS about when and how your enter in USA and what category where and when you got your Visa.
    Mentioned about where you were before coming to USA and submit any proof if have like your were working in India in those days and the proof like pay stubbs, or company letter explaning your were working there.
    Any other proof that you never been in US pror to your first entry.

    Dont forget to submit your visa copies, passport, H1 or L1 or F1 copies, Departure/Arrival record, any expired passport copies showing any visa on it.
    Politely point out that may be your name match some one else. If your have attorney ask him to write a letter.
