Need some help with the following questions.
I am a physician working towards completing my 3 year J1 visa waiver requirement.
Background Information:
In 2004, moved to US on H4
Between 06/2007 - 06/2010, changed my visa status from H4 to J1 for attending college(physician residency)
After completing residency, applied for J1 Waiver
After J1 Waiver approval, changed visa status to H1B after signing a 3 year contract
Intended Plan:
After 3 year contract is over on H1B, I would like to apply for GC AOS using my spouse's
approved GC with priority date in 03/2005
Questions:
Is it possible to file for GC AOS using my husband's approved GC and priority date ?
While on H1B(J1 waiver job), I had to take maternity leave for 3 months and 1 week (4 weeks before delivery using EDD Disability Insurance + 1 week before delivery unpaid + 6 weeks after delivery using EDD Disability Insurance + 2 weeks after delivery using accrued vacation time). Now the question is, do I need to make up for any or all of this maternity leave period at the end of 3 year contract before applying for AOS ?
So far I have not taken any FMLA(employer sponsored or unpaid), but just in case if I have to, do I need to make up for that time as well at the end of 3 year contract period ?
