I-485 RFE re Legal Name
I have applied in EB1 at Nebraska Service Center and LIN number is in range of LIN12902312XX. I received an RFE on I-485 (08/16/2012) to provide evidence of the legal name. My passport and birth certificate name matches (XY) but in the I-485, I had added my last name and applied as (XYZ)). I am trying to get my last name added in my legal name in India. I am not sure if an Affidavit provided by parents and signed by 1st class Magistrate will be accepted by USCIS as legal name change document. Please suggest how to address this RFE.

Affidavit doesn't accept by USCIS. You should changed your name with defined process ( Which is a long process).
If you are planning to change in India, you have to give ad in the paper, and other formalities and change to your Birth certificate.
In US also you need to give ad in news paper and follow with Consulate/Embassy guidelines and change in your passport.
I think it will take sooner in US.
Step one : Visit embassy website to check the rules and forms to filled and submit.
Step Two: Give ad in a local news paper (Cost you 100 to 150 dollars)
Step Three: Submit ad cutting and forms to embassy, and get the certificate with in 3 days or even expedite by showing them your RFE.
Step Four: Change Name in your passport, expedite process.
