  • Should I leave my EAD separate from my wife's filing?

    Hello,

I received my EAD about 5 months ago (under EB2). I recently got married and my wife has her I-140 approved under EB 1A. She will soon file for I 485. My attorney says that he is going to ask USCIS to JOIN my existing EAD with her application. Is it safe to do that or should I invest the extra $ 1000.00 and file a brand new application with USCIS so that my wife and I get a complete new processing? I'm concerned about joining my EAD with my wife's because when I try to become independent of my current employer (after completing 180 days on EAD), my employer will probably revoke my I 140 which could lead to a RFE on my case. Please suggest the best method to get the green card safely.

    Thanks in advance.

In my knowledge you can apply as derivative for your wife. But why you have to do so. You are in EB2 and your date is current so you got EAD. You can work independently on EAD as your GC is future emp based.
Soon you will get your GC ( if you are current mostly people are getting within 4 to 8 months)

Your wife is on EB 1, so let her file herself alone. Sooner or later both of you get GC within a year or soon.
Some time link your EAD means you become derivative to your wife application.
it depends on you, if her chances are good that she get GC sooner then you can link your application.
