Hi. I got married with U.S. citizen i want apply for adjust my status but my wife's income less and she cant be my sponsor. so my brother in law wants to be my sponsor. his has 2 daughter and their mother(his girlfriend) his household are 4 people. his annual income is $24,000 and his girlfriends is $12,000 but she got job couple month ago she never apply for tax return. Can they be my sponsor or not. Thank you so much.

As of January 26, new 2012 poverty guidelines published by the Department of Health and Hospitals have gone into effect.

[B]US Citizenship and Immigration Services (USCIS) uses a 125% multiplier of the guidelines to determine the minimum income a petitioner must make to be able to qualify as sponsor for a family-based immigrant. Those looking to petition for a family member should review the guidelines and be prepared to show income of at least 125% of the amount shown for their family size, or find a joint sponsor who qualifies under the same guidelines. USCIS has not updated its guidelines for 2012 but change from the agency is expected at any time.
The following guideline figures represent annual income.

Your BIL family is 4 + you 2 = Total 6 Persons.
Do the math 6 X 125%

If his income is not enough then you can take a joint sponsor. Your BIL and some one else who filled his taxes for year 2011. (If you are planning to file AOS in 2012)
