Please let me know if you know the answer to this:
My husband (US citizen) had NOT filed taxes for last year 2011. Should we still send in all the forms and check the optional box (he can send his tax returns from 2010 and 2009 - so only missing last year's return). He will also add an employment letter stating his salary for this year (and yes, he is over the poverty limit).
Will they still accept it, I think I read in the instructions that taxes for last year must have been filed if not you will get your application in return?
Is there anything else he can do? Can we for example add a explanatory letter with a phone number to his tax lawyer, saying he is in the process of filing taxes for last year?
He will definitely file taxes for last year, but I do not want to wait for another 2-4 weeks to send in the forms all together.
