  • I-485 initial interview (EB 2) Please Help!!

    Guys,

    I have received letter to appear for an initial interview for a pending I-485 application while PD being not current for myself and my husband.
    I have my interview in 2 weeks. My case is employment based.
    Here is my Case details:
    1. My GC was filed when i was working with Employer A with PD March 15 2010, I-140 Approved on Dec 2010.
    2. In December 2011 i have moved Employer B on H1b.
    Note: I have worked to employer A for nearly 4 years before i moved to employer B.
    3. In March 2012, My previous employer A has agreed to file I-485 for me and my husband as my PD was current.
    4.In that letter following documents where asked
    A Completed Affidavit(s) of support (Form I-864) with all required evidence, including the following , for each of your sponsors (unless already submitted):
    a) Federal Income Tax returns for W-2's, or certified IRS printouts, for the most recent year;
    b) Letters from each current employer, verifying current rate of pay and average weekly hours, and pay stubs for the past 2 Months;
    c) Evidence of your sponsor's and /or co-sponsor's United States Citizenship or Lawful Permanent Resident status.

    Q) for(c) do it need to take employer A employment verification letter?

    Please feel to suggest what documents should i prepare for interview from employer A(previous) and employer B(Current).

    You have to provide all the documents what they asked.
    If your pay is enough for your family ( We don't now how many members in your family) then you no need affidavit of support.
    You can show him your income tax returns. ( Hope you are filled jointly with your husband).
    Call IRS or go online and request official transcripts from IRS, which are genuine. Once you get those then you can attest with notary.
    Take all your yearly W2's since you entered US/start working + Your Husband W2's.
    (There is a question if your employer A is the one who filled your GC, then why you are not working with him currently?) Be prepare for the answer. ( Take a letter from the Emp A that he is responsible and gives you employment once you get a GC - but why not currently you with him state a reason).
    Take a letter from Emp B, your designation, salary, etc.

    I hope you met all the conditions. The question for why you are not working with employer A who filled your GC - This will be the tricky one.

      Thanks for your Feedback.
      The things i can carry with me for interview are
      1. I have all my W2's since i came to US.
      2. I Have all Pay stubs including my current employer.
      3. I Have all experience Letters from all my previous employers, as well the Last employer (who is sponsoring my GC and filed my I 485).
      4. Current employer whom i am working with.

      Question.
      1. The Attorney who filed my I 485 is not providing the I-485 packet(documents) which they have submitted + Employer who filed my I 485 is not providing the Updated EVL. ---- Can i attend interview without this documents?

      Please advise me on this

        That's good but atleast you should have Labor certification/what job they applied for you and you should have the experience certificates related to that job.
        - You should take all your I-797 receipts (including I-140 approved notice, I-485 receipts etc).
        - The question still remains - Why you are at different employer? why not with the employer who filled your GC - You must have a solid answer.
        (There is some thing flag on your file that's why they call for interview) people change employers but if they get GC without interview its good. I am not scaring or upset you just prepare before you go.

        If your employer who filled GC can give you a letter its excellent you have no issues. There is a chances 50/50 he can ask this question/ May be or not.
        Go there and let see - You can say yes after GC I will work with the employer who filled my GC? if the IO ask any questions.
