  • Reapplying for Greencard through a new marriage

    I was married to a U.S citizen for 5years, i applied for a greencard and was denied on the basis that it was fraudulent. At the same time i lost my work permit and couldnt find a job for a while, during this period my marriage fell apart and my spouse totally changed and kicked me out of the house, she then moved without telling me to where she moved to. Fast forward, I have now moved on with my life and met a beautiful woman who loves me unconditionally. She is a U.S citizen through marriage as well and is divorced, i myself not officially divorced but been separated for 2 years now. We will get married soon, and shes thinking of applying for a greecard on mybehalf, but i do not know what the repercussion this can cause following that she also got her citizenship through marriage.
    I guess my question is, is there anything that would stop us from being successful in this process taking in consideration our historical background of both being married and previously being involved in immigrational process especially that mine got denied. Also i have not been asked to leave the country by immigration.

    Please advise
    Your responses will be greatly appreciated.

    Good to know that finally you got a nice women, who can take care of you.
    There are thing to follow before your marriage.
    1. Get divorce from your first wife - Get her contact info (mailing address etc) and ask her to file mutual divorce so get soon. (means both can sign the papers as they have no obligation to get divorce).
    2. If she not agree, hire any divorce attorney, and file a case in court. They will send a letter to her to respond, if she didn't respond then you will get divorce.
    - You can't marry another women without divorce to your current wife.
    3. Meanwhile you can keep dating your GF, keep all the evidence like FB chat, phone contact, text, Gifts etc ( At the time of interview if they ask you can show them as this is a bonafide marriage.
    - check if your name is in deportation list
    4.After divorce, get married to your GF, then submit your application. (Make good evidence, Joint bank account, joint lease, joint property, joint utility, joint car insurance, joint life insurance etc)
    5. More genuine is if she become pregnent.
    _ Doesn't matter if your GF become citizen through marriage and get divorced. But both of you need to know well each other.
    What are the reasons got divorced etc.

      it will be almost impossible to get a Lpr/GC .unless you successfully clear the ground of denial of your initial GC application cos a allegation of fraudulent marriage makes you ineligible for GC till thine kingdom comes.

        You might need to file I-601. if you have any deportation order you must clear it.
        Better you should consult an experienced attorney. As we can discuss in the open forum.
