  • Processing time for I-485 in this situation

    Hi - I am an immigrant and came into the US on a tourist visa in the beginning of the year and stayed longer after my getting 6 months on my I-94. During this time I got married to a US Citizen. I applied for my I-485, I-130, I-765 and the Advance Parole all at once on June 11th.

    There was an issue with the papers submitted, and 1 page was missing so it was sent back 2 weeks later and we re-sent it the same day.
    I then got notice for my FP appointment for July 24th.
    After that on July 6th I got a text saying further evidence was required for my paperwork. We got the notice in the mail on July 13th and it was about my spouse's employment evidence. He was unemployed before we got married so we submitted whatever paperwork we could including a joint sponsor to be safe. Since he changed to full time employment in July after the first application was submitted we waited until we had at least 3-4 pay stubs to show for his employment. So that meant a delay of 1.5 months. We sent in the required evidence with some pictures of a few trips we made together in the time between. This was sent on August 26th and we received notice a few days later that they got the evidence and would be processing the paperwork.

    Exactly 4 weeks later which is today Sept 26th I got a text saying my I-765 and my AP were approved and I am to await the notice/card in the mail. I understand the Employment card can take upto 30 days to arrive?

    My worry is I have been unexpectedly in the US for the last 9 months would like to know how much longer this process will take. When should I expect an interview date and how soon after that would I get my green card?

    I would really like to travel in November/December and was hoping this would come through by then.

    Appreciate any advice you can give me. Thanks

    Two different issues rolled into one. For traveling outside the country - you can travel as soon as you get your combined AP/EAD card. If you got the notification today, the card should be arriving within the next two weeks - or earlier.

    About getting the green card - your situation (coming with a visitor visa, marrying a USC, applying for LPR status) is highly frowned upon by the USCIS. Because, honestly speaking - how many people travel on a visitor visa, then suddenly find the love of their lifes while on vacation - and immediately marry? So, be prepared for your case to take a long time, if not altogether denied.

      Thanks for the response. I didn't immediately marry him, we got married almost 4 months after I entered the US. I was visiting to attend a conference in Canada, and I decided to stay longer in the US. I had to cancel my return ticket too. We met last year after I came on a week trip to the US to attend the same conference.

        Timeline for Adjustment of Status- Marrying US citizen

        I would like to just inform you of my situation which was exactly like yours & provide you with a timeline. I came here on a visitors visa & married a US citizen. I filed on June 8, 2012, did my interview on September 24, 2012 & was approved. If u need any help feel free to ask me as I completed my application myself just by using this forum & the USCIS official site & instructions.

        I never got any request for additional documents/ information and nothing was sent back. The interviewing officer said I did an excellent job & should have been an attorney LOL. I used experiences on this site to help as well.

        From my experience, the cards in the mail takes a week to get to you. You get them long before the 30 days limit.

        Fingerprinting Appointment- July 11, 2012
        Received EAD/ AP Card- August 15,2012
        Interview- September 24, 2012- APPROVED

        Received email today Sept 27, 2012 informing me of my Permanent resident card being sent to me in the mail.

        People fall in love after 3 dates, as long as it's a true marriage & your paperwork & supporting evidence is in order, then everything should be fine.

          Thank you for your message. I really appreciate your motivating response. I wanted to ask you a few questions:

          1. When you say you received EAD card was on Aug 15th or was that the notice on Aug 15th? As far as I am aware you get the notice, and then wait a few weeks?
          2. If your interview was on Sept 24th, when did you get your interview notice?

          Basically I just want to gauge if there a chance that I might get an interview notice in the next few weeks considering I just got a message from them saying my EAD card is on its way to me.

          Appreciate your advice.

            I received my EAD/AP card notice via text & email on August 11, 2012 & received the card a couple of days later on August 15,2012. (less than a week)

            My interview notice came 2 days later & was dated August 16,2012 & the interview date was September 24, 2012.

            Make sure you gather as much pictures as you can & all your supporting evidence. Personally, I had an entire scrapbook of pictures which the officer did not look at. Once he opened my wedding album (we had a big wedding) he was convinced. We only had bank account together & the utility bill.

              Thank you for your response. I got a text my EAD card was in the mail so I should have it this week. Just waiting to hear about the Interview. Once I get my EAD I am going to try get a SSN asap so I can get another bank account together (I already gave them a joint bank account statement). I also will get insurance, and on the house lease so hopefully this will all suffice when we go for the interview (if I get the date soon enough).

              Did you have to show a religious marriage certificate or is the wedding pictures enough?

                i485 parent of us citizen

                I'm mother of usc. My son sent package Aug/17/2012. On aug/24/2012 they sent me receips. Last Sep/25/2012 I went to biometrics and fingerprinters. I haven' t received any notice. I want to know what is happenning. I arrived to USA with tourist visa, my form i94 andy son is military. Will I have an enterview?

                  Oct 23 uscis update my case. They will send me notice about my i131. About my i765 uscis ordered to malr the docent . Im so happy.

                    Please accept my apologies as I was out of the country and came back recently. Hopefully have your green card by now.

                      Wife didn't change her name

                      I am a F1 student who got married to US citizen after two years of living together. I got notification for an interview but I am just wondering about this. She didn't change her last name to mine. Will that be a problem at the interview or will it affect the process entirely. Thanks
