  • 1 year since interview?

    So here's my situation:
    We had an interview back last october and were neither approved nor denied. We were told we would receive something in a couple of weeks. We have received nothing. Since then I opened an inquiry with customer service and was told to wait another 6 months, 6 months ago. It all comes down to the definition of a crime committed in another country that I was convicted of. For my own sake I don't want to go in to it on here. I cannot afford a lawyer, so, I am hoping that this is just a matter of it getting buried, as the mark is coming back up. Any words of wisdom from those who have been through this? We also just renewed her EAD card, though she does not work.

    - Take an info pass and visit to your local office.
    - Did you have any documents that you are acquitted with that crime,(You need documentary evidence/Judgement etc).
    - Is it a serious crime?
    - Did you submitted documents about this crime along with your application.
    - If it's small crime then you may get either RFE or asking to submit I-601 waiver.
    - Please see the USCIS website for waiver required for crimes.

    There is a hope, they may approve without any other requests.

      I was not acquitted, the process started after I was deported from that other country, my sentence was technically not even over at that time. I am not sure how severe it is considered, but I assume severe enough to be considered serious. I did not submit documentation as it was not asked for in the application. I was questioned extensively about it in the interview as was my wife. It seems that this is the final hurdle, so to speak for the AOS. He had no problem stating that the marriage is genuine. He just never followed up with us and I'm getting worried that the longer it goes, the more it seems that it will be denied and I won't have any recourse (money is tight). Thank you for your advice, I will look in to it.

        As per your post " I was questioned extensively about it in the interview as was my wife" means the USCIS knows about your back ground. However it depends on the crime you commited to let you adjust the status here.


        I think they may ask you to submit a waiver.

          Sorry to hear about that but you are not alone cuz I am on the same boat with you. I got 2 times interview and it has been over a year since my second interview in Oct, 2011 and got no update so far. I came twice with the info pass to local office and 2 service request with Customer Services. I have just renew my EAD and Travel document for free of charge and still waiting for a decision. It will be 2 years in May.

          I am going from worrying to careless now. But I hope a lot of lucks for u
